Breach of Contract Business Services

At Zelnick & Erickson (ZE), our Virginia business attorneys can help you enforce your business contracts. If a contract is breached, we will discuss your options, and suggest the best course for legal remedy. This may include:

·    Monetary damages;
·    Specific performance/injunctions; and/or
·    Rescission or reformation.

Pursuing Damages

If a contract has been breached, the most common remedy is to pursue monetary damages from the breaching party. Our Virginia business attorneys will take the time to thoroughly investigate your claim in order to maximize the recovery to which you are legally entitled.

Specific Performance/Injunctions

If damages won’t suffice as an adequate legal remedy, in certain cases you may pursue a remedy that is known as Specific Performance. This means that the court can order the breaching party to perform its obligations under the contract.  If an injunction is sought, a court can order the breaching party to refrain from further breaches.

Rescission and Reformation

In certain other cases, if damages don't suffice as a legal remedy, you can seek to rescind or reform the terms of a contract.  Although not a commonly used remedy, rescission or reformation can be an important tool in the right circumstances.
